Yeshiva Academic Institutional Repository: User's Guide

Submitters are required to agree to the YAIR Distribution License Agreement when depositing their works in YAIR.

Why? The distribution license agreement allows YU to post the submitter(s) work online. It is a non-exclusive agreement so the creator's rights are maintained and the work(s) can also be in other open access repositories, e.g. PubMed Central.

How? The distribution license agreement is part of the item submission process.

NON-EXCLUSIVE DISTRIBUTION AGREEMENT

By signing and submitting this agreement, I, _______________, grant to Yeshiva University ("the University") the non-exclusive right to display, reproduce and distribute my submission in print or electronic format in all forms of media now and hereafter known.

The University acknowledges that this is a non-exclusive license and that any copyrights in the submission remain with me or other copyright holder.

I represent that the submission is my original work and that I have the right to grant this license to the University. I further represent that the submission does not, to the best of my knowledge, infringe upon any third-party’s copyright. If the submission contains material for which I do not hold copyright, I represent that I have obtained the unrestricted permission of the copyright holder to grant this license to the University and that such third-party material is clearly identified and acknowledged within the text or content of the submission. I agree to indemnify and hold harmless the University and its employees or agents for any uses of the material authorized by this agreement.

If this submission is based upon work that has been sponsored or supported by any agency or organization other than the University, I represent that I have fulfilled any right of review or other obligation required by contract or agreement with the supporting entity.

I understand that the University will do its best to provide access to my submission according to my election, and that the University will take reasonable steps to clearly identify my name as author or owner of the submission.  I understand that the University does not warrant that the submission will be perpetually or consistently preserved or accessible.

______ OPEN ACCESS:  Allows worldwide Internet access with a Creative Commons Attribution-NonCommercial-NoDerivs license deed to my work.

______ RESTRICTED:  Restricts entire work for a period of two years after deposit with Yeshiva University Libraries for patent and/or proprietary purposes. At the end of the two-year period, status will automatically change to Open Access unless I contact Yeshiva University Libraries to specify otherwise.

______ YU Only:  Only allows YU Communities access to my work.

______ OPT OUT:  Does not release my work for Internet access unless I provide written permission in the future for doing so.
